VILLAGE OF MEAD PLANNING COMMISSION MEETING MINUTES

November 24th 2003

The Village of Mead Planning Commission met at 7:30 p.m. Present were Cecelia Scoles, Pat Hannan, Connie Schliffke, Jody Weible, Billie Shook, and Melissa Konecky. LeRoy Nelson was absent. The minutes from the October 27th, 2003 meeting were approved with the following corrections:

In the first paragraph, Larry Raver was incorrectly referred to as Ron Raver. In the paragraph referring to Gary Else's request to install a fence, it was incorrectly noted that "Al voted yes in a roll call vote." It should have said, "All voted yes in a roll call vote."

NEW BUSINESS:

Terry Hass' Building Permit Application

A building permit application was submitted to build a pole barn on his property at 1548 County Road 11. Since all setbacks were met and there are no problems with the pole barn, Jody motioned, and Connie seconded, that we approve the permit. All voted yes. The motion carried.

Linda and James Malik's Building Permit Application

A building permit application was submitted to move a garage at 19 North Pine. According to 11-404 in the Additional Regulations of the "Mead, Nebraska Comprehensive Development Plan," setbacks would be met and there were no other problems with moving the garage. Connie motioned, and Jody seconded, that we approve the permit. All voted yes. The motion carried.

David Arthur's Building Permit Application

A building permit application was submitted for a shed to be used as a pigeon loft at 419 South Spruce. Since all setbacks would be met, Billie motioned, and Cecelia seconded, that we approve the permit for the building itself, but not for the pigeons. All voted yes in a roll call vote except Connie, who voted no. The motion carried.

We discussed the question of whether pigeons are allowed in town. Billie was told that Mr. Arthur bought the property because he was told that pigeons would be allowed there. However, Scott Little was previously forced to get rid of his goose, and Warren Johnson was previously forced to get rid of his rooster. Warren was taken to court over the issue of the rooster. According to the Webster's Dictionary, pigeons are fowl; and according to 6-202 (ANIMALS: BANNED FROM MUNICIPALITY) in the Mead Code Book, "It shall be unlawful for any person to keep or maintain within the corporate limits any horse, mule, sheep, cow, swine, fowl, or other livestock." However, according to 6-205 (FOWLS: RUNNING AT LARGE) IN THE Mead Code Book, "It shall be unlawful for any person to allow poultry, chickens, turkeys, geese, or any other fowls to run at large within the corporate limits, except in enclosed places on private property." But, 4-302, 11. in the Mead Code Book disallows fowl (copy attached). In the "Mead Nebraska Comprehensive Development Plan," 11-304 (DISTRICT (A-1); AGRICULTURAL, B. 10, an agricultural district is the only type of zoning district that allows fowl.

OLD BUSINESS:

We will discuss proposed changes to the zoning regulations in January. We will then pursue the zoning map update.

CONCLUSION:

Jody motioned, and Connie seconded, that we adjourn the meeting at 8:22 p.m. All agreed. There is no meeting scheduled for December.
